1. Who you are contracting with
These Terms & Conditions (the “Terms”) form a binding agreement between you and Highway Urgency Response Team, LLC, a Georgia limited liability company trading as “HURT Roadside Assistance” (“HURT”, “we”, “us”). By using our website, requesting dispatch, or purchasing a service you agree to these Terms.
2. The services
HURT provides mobile roadside assistance in the Atlanta, Georgia metropolitan area, including mobile tire change and replacement, jump-starts, battery replacement, lockout service, fuel delivery, EV charging, towing, and related heavy-duty services.
3. Eligibility
You must be at least 18 years old and legally able to enter into a contract. If you request service on behalf of a company or fleet, you confirm you have authority to bind that entity.
4. Acceptable use
You must not use our website or services to:
- break any law or regulation;
- commit fraud, send spam, or misrepresent who you are or where the vehicle is;
- infringe anyone’s intellectual-property rights;
- interfere with the security of the site (malware, probing, scraping, brute-forcing);
- resell or redistribute our services without our written consent.
5. Intellectual property
The site, our brand, logos, software, photography, and documentation are owned by Highway Urgency Response Team, LLC or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the site to request and pay for service. All other rights are reserved.
6. Payment, billing, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle’s Buyer Terms (paddle.com/legal/checkout-buyer-terms), which apply to every transaction in addition to these Terms.
Prices shown on the site are estimates for common situations. The final price for a job is confirmed before a technician is dispatched. Once you authorise dispatch you agree to the non-refundable dispatch fee disclosed at checkout for that job.
7. Refunds
Refund handling is described in our Refund Policy, which is incorporated into these Terms.
8. Service level & warranties
We work to dispatch quickly and to perform every job to a professional standard, but we do not guarantee uninterrupted, error-free, or instant availability. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence where such exclusion is prohibited by law.
9. Limitation of liability
Subject to Section 8, our aggregate liability arising out of or relating to the services in any 12-month period is capped at the total fees you paid us in that period. We are not liable for indirect, consequential, or special damages, including loss of profits, data, goodwill, or business opportunity.
10. Your indemnity
You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, your misuse of the services, or content you submit through the site.
11. Suspension & termination
We may suspend or terminate your access to the site or refuse service for: material breach of these Terms, non-payment, suspected fraud or security risk, abusive behaviour toward staff or technicians, or repeated or serious policy violations.
12. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of laws principles. The courts located in Fulton County, Georgia have exclusive jurisdiction over any dispute, except where mandatory consumer law provides otherwise.
13. Assignment
You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
14. Force majeure
Neither party is liable for failure or delay caused by events beyond reasonable control, including severe weather, natural disasters, civil unrest, or infrastructure outages.
